Trial is Error

It has been nearly 5 months now after the 26/11 attacks on Mumbai, the financial capital of India. Still there is no sign of justice or any stern action taken against the masterminds behind the attacks. India has already submitted dossier to Pakistan with all the necessary evidence claiming that the terrorists are of Pakistan origin.

Pakistan dogged by its own political problems, invasion of Taliban and terrorised by their own non-state actors has lost focus on punishing the accused of 26/11 attacks on India. It is just an eye-wash for India when Pakistan had been claiming that all the suspects have been arrested and investigations are going on. No one knows the actual truth. It won't long before this incident fades away from every one's memory. Can we expect any justice or concrete action taken against the criminals? India has been pressing this issue with the help of other nations like the United States, UK and other UN countries to dismantle terrorist organizations within Pakistan. Today it is India and tomorrow it may be any country that will become a victim of terrorism, if fast action is not taken by Pakistan. Considering the audacity of the Taliban Chief Mehsud who gave a statement in public that he is planning an attack on the United States which will be one of a kind and would cause maximum destruction, its high time Pakistan acted on these terrorist groups.

After much controversy on who will take up the case of the lone captured terrorist Ajmal Kasab, finally we have Abbas Kazmi who has taken up Kasab's case. The much awaited Trial is underway at the highly secured Arthur road Jail in Mumbai. Excuse me! What are we doing here? Are we trying a terrorist who is responsible for waging war against India and responsible for death of hundreds of innocent citizens in the court of law? A statement in one of the newspaper said "Kasab will be tried in the court of law and if found guilty, he will be punished". Does the law still think that Kasab is not guilty? Of course he is and the whole nation has seen it. We have enough evidence of Kasab and his accomplices for their inhuman acts.

I am not here to exploit loop holes in our legal system and I am aware that even hard core criminals get a chance to be tried in the court of law. In Kasab's case, trying him in the court is just adding on financial overhead for the Indian Government. Think of the amount of money that has gone in facilitating security for this captured terrorist. Police protection, bomb proof enclosure, security arrangements, ensuring his health condition etc. all for a person who has committed an unpardonable crime.

Most of us as Indians would like instant justice to be done to the innocent victims.Death in an encounter for Kasab like his accomplices from Pakistan went through. Human rights activists, please forgive me but I think Kasab deserves nothing less than death for the acts that he has committed.

As any other fellow Indian hoping that justice will prevail and Kasab and all others behind the 26/11 attacks get the deserved punishment we all have been looking for.

Hi Sandy,

I was writing a post on the same subject, the title being "Trial In Error", but after having scribbled for some 20 minutes, I gave it up out of sheer disgust.

I knew this would happen with Kasab, eventually some lawyer (sadly from his own kaum) will stand up for me and as expected he has already started delaying the process by asking for things that are not legally binding. There is also a circumstance the Kasab is a minor and hence the nature of the whole punishment could probably change. Its all in mess unless Ujwal Nikam stands firm and sees that justice in done. However, our country is famous for the tag "Justice Delayed" but we dont understand the fact the "Justice Delayed is Justice Denied".

What I dread further is the Sainiks (MSN and SS) going on a rampage if Kasab gets free or anything less than a deserving punishment, and that would look justified at that time.

Looking at everything, I just sometimes feel that a statement of one of the victim's family is very apt - "hang Kasab in front of Gateway of India", after all who better would know what the victims and their families have gone through and going through.

In all faith, lets hope for the best.

Recently read in Rediff that the chargesheet has more than thousand pages. Now Mr. Kasab wants this to be translated to Urdu though it is already written in Hindi, English and Marathi if I remember correctly.

Let's say against all the odds, even if Kasab's case passes all possible courts including Supreme court and Supreme court decides death sentence also, Kasab won't be hanged!!!

Thanks to our very own constitution which allows President to overrule the decision of the Supreme court!!!

I wouldn't be surprised if the so-called human rights groups decide to protest against hanging Kasab.

It's painful to see a decision by a group of learned judges in the highest ranking of the country, is over-ruled by one person.

What is Kasab's age? Court orders probe If the inquiry establishes that Kasab is juvenile, then the case will be transferred to the juvenile court.

The maximum punishment prescribed under Juvenile Justice Act is three years, Kazmi said.
